BISTLINE, Justice, dissenting. The majority opinion correctly reprints art. 1, § 8 of our Idaho Constitution. It reads now as it did when ratified in 1889. A fortiori, it reads now as it did in 1947, 1948, about which time Justice Donaldson and myself were studying criminal procedure at the College of Law in Moscow.
