SANBORN, Circuit Judge. In this case the plaintiff below, Charles A. Stookey, recovered a judgment of $10,695.82, the unpaid balance of the agreed price of the construction of a system of waterworks, which consisted of three settling basins, boilers, pumps, power house, pipes, distribution mains and hydrants, for the city of St. Charles The contract price of the works was.about $84,000, and the city had paid the contractor about
