WINTER, Chief Judge: This appeal arises out of a class action for civil rights violations brought by prisoners after the riot in Attica prison in 1971. Karl Pfeil, a former Assistant Deputy Superintendent at Attica, appeals from judgments in favor of Frank Smith and David Brosig. Plaintiffs instituted this class action twenty-five years ago against Pfeil and other New York State officials and corrections
