Asch, J., dissents in a memorandum as follows: Defendant-appellant was convicted, after a jury trial, of kidnapping in the second degree, unlawful imprisonment in the first degree, and criminal possession of a weapon in the fourth degree. He was sentenced to concurrent terms of from 6 to 12 years on the kidnapping count and from 2 to 4 years on the unlawful imprisonment charge, and received an unconditional discharge on the weapon
