Cases

In an action to recover damages for personal injuries, the defendant appeals, as limited by its brief, from so much of an order of the Supreme Court, Queens County (Elliot, J.), dated December 21, 2006, as, upon renewal, adhered to its prior determination in an order dated July 13, 2006, denying the defendant’s motion for summary judgment dismissing the complaint. Ordered that the order is affirmed insofar as appealed from, with costs.<

Plaintiff Maria del Carmen Onrubia de Beeck, a citizen of Peru, filed a summons and complaint in February 20061 seeking a declaratory judgment that she is the owner of the bearer shares of Williamsport Capital, Ltd., a British Virgin Islands company, and as such, that she controls its Israeli Discount Bank account, located in New York.
