Gaynor, J. The plaintiff is the beneficiary in a benefit certificate for $1,000.00 issued by the defendant to her daughter, Fern Teter. The daughter died and the defendant refuses to pay, and plaintiff brings this action upon the certificate to recover the amount therein provided. The defendant is a fraternal benefit society organized under the laws of this state, and doing business in this state.
